Jelen tanulmány a kereskedelmi szerződésekkel kapcsolatos viták joghatósági kérdésével foglalkozik a Brüsszel I. rendelet 5. cikk (1) (b) és annak elődje, a Brüszzeli  Egyezmény,  valamint  az  új  Luganói  Egyezmény  szabályainak  alapján. Azt  vizsgálja,  hogy  az  Európai  Bíróság  Color  Drack-  (C-386/05),  Car  Trim- (C-381/08) és Electrosteel- (C-87/10) ügyekben hozott ítéletei mennyiben egyértelműsítik a korábbi gyakorlat alapján fennálló bizonytalan helyzeteket, valamint hogy ezek a döntések vajon egy konzisztens joghatósági szabály „megteremtése” felé mutatnak-e az Európai Unióban.

Synopsis: 

This article considers the issue of jurisdiction in commercial contractual disputes under the article 5(1)(b) of the Brussels I Regulation (on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters), the preceding

1968 Brussels Convention and the new Lugano Convention. It examines whether the decisions of the European Court of Justice in Color Drack (C-386/05), Car Trim (C-381/08) and Electrosteel (C-87/10) cases have clarified previous uncertainties and made progress towards a consistent set of rules on jurisdiction across the European Union.
