A tanulmány a nemzetközi szerződési jog területén bekövetkező újításokat kívánja bemutatni, konkrétan az Európai Bizottság rendelettervezetén keresztül, a közös adásvételi jogról, amelyet 2011 októberében publikáltak, és jelenleg is zajlanak a munkálatai. Bár az Európai Parlament támogatja a javaslatot, számos kérdés és fenntartás merült fel az új eszköz tartalmával szemben. A tanulmány elemzi azokat a körülményeket, amelyek elvezettek a tervezet megalkotásához, valamint az új jogi eszköz mellett és ellen felmerülő érveket.

Reforming Common European Sales Law reflected on the preparing Regulation of the Commission
Synopsis: 

The target of this study is representing the processes of renewals in the domain of  international  private  law,  especially  in  the  field  of  the  international  sales  law, through the Commission’s new proposal, which had been published in october 2011, namely ’the Proposal of the Common European Sales Law’ (CESL).

The innovations and new goals of the european legislation are showed very well in this ’opt-in’ instrument, which offers a single set of rules for cross-border contracts in all 27 EU countries.

However, the European Parliament Commitee backs the CESL, there are a lot of question and conservation about the new instrument and its further impacts on the existing international regulations. This study focuses on the circumstances which have led to the birth of this proposition. Secondly, it examines the main reservations and counter-argumentations against the CESL, in regard to the questionable legal basis of the new instrument, and its relation with the other regulations in this area. Finally, the study makes conclusions, alluding to the suggestions of the European Law Institute.
